These Terms of Service (“Terms”) are an agreement between you and LocalRun, a service operated by . They apply when you use our websites or apps, place an order, or otherwise use LocalRun. By using LocalRun you agree to these Terms and our Privacy Policy. Businesses, drivers, and Jobs users also agree to the Merchant Agreement, Driver Agreement, or Jobs Terms.
1. What LocalRun is
LocalRun is a local ordering and delivery network serving . Independent local businesses sell their products through LocalRun, and independent contractor drivers deliver them. The business — not LocalRun — prepares your order and is responsible for its quality, safety, and contents. Drivers are not employees of LocalRun or of the businesses.
2. Using LocalRun
- You must be at least 18 (or the age of majority where you live) to place an order, or use LocalRun with a parent or guardian’s permission.
- Give accurate information, including your phone number and delivery address, and keep any PIN or passcode private.
- Don’t misuse the service: no fraud, abuse of drivers or staff, false chargebacks, scraping, or attempts to break our security.
3. Orders and pricing
- Online prices may be higher than in-store prices. LocalRun adds a markup to online item prices to pay for the delivery network and card processing. Pickup and delivery prices can differ.
- Delivery fee. Most delivery costs are built into online prices. A separate delivery fee applies only when an order is small or far, and is shown before you pay.
- Tax and tips. Sales tax is added as required. Tips are optional, and 100% of your tip goes to your driver.
- What you pay. The total shown at checkout is what you’ll be charged. Prices, availability, hours, and delivery areas can change, and an item may sell out after you order — the business or LocalRun will contact you if something isn’t available.
- Age-restricted items require a valid ID at pickup or delivery; some items can’t be delivered.
- Delivery. Delivery is available up to miles from the business, when drivers are available and the business is open. Times are estimates. If you choose no-contact delivery, you accept that the order may be left unattended.
4. Cancellations and refunds
- You can cancel an order yourself shortly after placing it, before the business starts preparing it, for a full refund.
- After preparation starts, contact us. If an order is missing items, wrong, or never arrives, we’ll work with the business to make it right — usually with a refund or credit for the affected part of the order.
- Refunds go back to your original payment method. Your bank may take several business days to show them.
- Please contact us before disputing a charge with your bank so we can fix the problem quickly.
5. Payments
Payments are processed by Stripe (or Square for some in-store orders). By paying you also agree to the processor’s terms. LocalRun does not store your full card number.
6. Ratings and content
If you leave ratings, photos, or messages, keep them honest and respectful. You give LocalRun permission to use them to operate the service. We may remove content that breaks these Terms.
7. Disclaimers
LocalRun is provided “as is” and “as available.” We don’t guarantee that the service will always be available or error-free, or that a delivery will arrive by a particular time. Businesses are responsible for the food and products they sell, including allergens and ingredients — ask the business if you have an allergy.
8. Limitation of liability
To the fullest extent allowed by law, LocalRun and are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of LocalRun. Our total liability for any claim relating to LocalRun is limited to the greater of the amount you paid for the order the claim relates to or $100. Some places don’t allow these limits, so they may not apply to you.
9. Your responsibility
You agree to cover claims and costs (including reasonable legal fees) that arise from your misuse of LocalRun or your violation of these Terms or the law.
10. Governing law and disputes
These Terms are governed by the laws of the State of Tennessee, without regard to conflict-of-law rules. Before filing a claim, please contact us so we can try to resolve it informally. Any claim that isn’t resolved informally will be brought in the state or federal courts located in Tennessee, and you and LocalRun consent to their jurisdiction. You may also bring an eligible claim in small claims court.
11. Suspension and termination
We may suspend or close an account that breaks these Terms or puts people at risk. You can stop using LocalRun at any time.
12. Changes
We may update these Terms. We’ll change the “Last updated” date above, and continuing to use LocalRun after an update means you accept it.
